Welcome to the private investigation service, offered by the FICSCOMPANY team, a company belonging to the VALIT group, or Valor Y Calidad de Negocios SpA, RUT 77.017.681-6, domiciled in Chile.

Please read the following terms and conditions carefully before using our services.

The terms and conditions constitute the entire agreement between the user and FICSCOMPANY with respect to the use of the private investigation service. If any provision of these terms and conditions is held invalid or unenforceable, such provision will be interpreted in accordance with applicable law as closely as possible to the original intent of the provision, and the remaining provisions will remain valid and enforceable.

At FICSCOMPANY, we are committed to providing you with a service of excellence and quality regarding private investigation, to help you obtain specific information, in order to resolve your concerns or particular situations.

ARTICLE ONE: PROPER USE OF THE SERVICE, the user agrees to use the FICSCOMPANY service in an appropriate and respectful manner. The user may not use the service for illegal activities or activities that violate the rights of third parties.

SECOND ARTICLE: DURATION OF SERVICE, the duration of the service of FICSCOMPANY will be defined according to the contracted plans, and any modification will be established and informed by our team.

ARTICLE THREE: AVAILABILITY OF THE SERVICE, we will do everything possible so that the FICSCOMPANY service is available at all times. However, we do not guarantee that the service will be free of errors, interruptions, delays or defects in operation due to any act of God or unforeseeable event.

ARTICLE FOUR: ELIGIBILITY REQUIREMENTS TO USE THE SERVICE, FICSCOMPANY, offers a private investigation service, and users must be at least 18 years old and have the legal capacity to accept these terms and conditions.

Likewise, FICSCOMPANY reserves the right of admission with respect to the user, without being required to inform the user of the basis for its decision.

ARTICLE FIFTH: PAYMENTS, the FICSCOMPANY service has a single cost, which will be established by our FICSCOMPANY team, and informed to the user. The user must make the payment corresponding to 50% of the contracted value at the beginning of the service and will pay the remaining 50% of the balance, at the time FICSCOMPANY prepares a final report with the collected information, balance that must be paid prior to the delivery of the report. Payments can be made through the payment methods available on our website www.secretosdescopias.cl and the company’s procedures will be enabled, once the payment is confirmed by WhatsApp messaging at the number +56 9 5694 5392 or by email sgarcia@ficscomany.com. Likewise, once the service is contracted, a form will be sent to the user through the official channels indicated above, for the purposes of starting the procedures.

ARTICLE SIX: EXCLUSION OF LIABILITY, FICSCOMPANY and its team do not assume any responsibility for the results that may arise from the use of the private investigation service.

The user acknowledges that any information provided by our researchers should not be considered advice, whether legal, medical, family, personal, financial, economic, or otherwise and should not substitute advice issued by a properly trained professional, according to the investigated matter. Likewise, the service should not be understood as espionage, access to unauthorized computer systems, and even less surveillance. The user assumes full responsibility for the risk of any action taken as a result of using the FICSCOMPANY service and expressly indicates that he excludes the company from liability, with respect to any liability arising from what the user executes with the report delivered by the company.

ARTICLE SEVEN: COMMUNICATIONS, we will communicate with the user through the email address provided during registration, or the telephone number indicated by the user. The user agrees to receive emails related to the FICSCOMPANY service, including invoices, notifications, reports and other important messages.

ARTICLE EIGHTH: INTELLECTUAL PROPERTY: FICSCOMPANY, reserves each and every one of the intellectual property rights related to our private investigation service, including, but not limited to trademarks, trade names, logos and content, are the exclusive property of our company.

Users are expressly prohibited from using any registered or associated trademark, trade name or logo without prejudice to the possibility of granting prior written authorization from our law firm or the company.

ARTICLE NINTH: MODIFICATION OF THE TERMS AND CONDITIONS, at FICSCOMPANY we reserve the right to modify these terms and conditions at any time and without prior notice. Any modification will be effective immediately after being published on our website www.fiscompanycopy.com.

ARTICLE TEN: CONFIDENTIALITY At FICSCOMPANY, we are committed to protecting the confidentiality of the information, collected in private research and/or provided by the user during the use of the FICSCOMPANY service, to the extent that our capabilities allow. All information that the user reveals during the investigation process will be kept absolutely confidential by the company. The information obtained will only be used for the purpose of providing the FICSCOMPANY service to the user. Any other situation must be authorized by the user together with the company. In FICSCOMPANY, all information provided by the user will be treated confidentially and will not be shared with third parties without the express consent of the user, unless required by Chilean courts of law or by law.

Likewise, calls and consultations with the user, remotely or by telephone, will not be recorded and there will be no record for the FICSCOMPANY team, so the conversation with a FICSCOMPANY will be unique and will not have a record for third parties.

Regarding the exclusion of liability for FICSCOMPANY, it is established that in the event that, without the consent or knowledge of the company, third parties record, reproduce, store and disseminate confidential information, whether these are users, intermediaries or other professionals, what which will constitute a serious breach of these terms and conditions, entitling the company, by operation of law, to exercise the corresponding legal actions with the legal statute applicable to the case.

ARTICLE ELEVEN: LIMITATION OF LIABILITY, in no case FICSCOMPANY, or whoever represents its rights, will be responsible to the user or any third party for any direct, indirect, incidental, special, consequential or punitive damages that arise from the use of the research service. private, even if we have been warned of the possibility of such damages, said situation is accepted by the user in case of subscribing and not objecting to the terms and conditions within the term of three consecutive days.

ARTICLE THIRTEENTH: DESCRIPTION OF THE SERVICE, in these terms and conditions, the private investigation service consists of benefits applicable to the entire territory of Chile, in the FAMILY area (child abuse, infidelities, wrongful divorce), WORK (infiltrations, abuse of workers or management, medical licenses), SEARCH FOR PEOPLE.

The approach to comply and execute is to deliver a quality service with respect and courtesy, based on the trust and sincerity of a clear and safe provision. After the activation of the service and its formalization, a team of investigators is assigned to your particular case and private or individual investigation activities are carried out. In these terms, the service provided by the private investigation company consists of a series of services that comply with all the rules, laws and internal regulations of Chilean legislation, and with special attention to the provisions of the Penal Code, Law of 21,459. on Computer Crimes, Law 19,496 on Protection of Consumer Rights, Law 19,628 on Protection of Privacy, as well as what is applicable regarding legislation international, referring to different conventions and especially the Budapest convention.

The service expressly excludes all conduct that is contrary to the law, especially the types of criminal offenses or crimes that are contemplated in the recently mentioned legal instruments, and as a consequence of this the FICSCOMPANY service does not contemplate phishing actions, hacking, computer fraud, illegal access, illegal interception or interruption, attack on the integrity of personal data, access to social network accounts or media such as WhatsApp, Instagram, Facebook.

ARTICLE FOURTEEN: TERMINATION OF THE SERVICE, at FICSCOMPANY we reserve the right to terminate the private investigation service at any time and without prior notice. In the event of termination of the service, any payment made for unused and/or delivered services will be refunded to the user. Any breach of these terms and conditions is grounds for terminating the service, unilaterally and prior to the company’s decision.

ARTICLE FIFTEENTH: APPLICABLE LAW AND JURISDICTION, The established terms and conditions are governed and interpreted in accordance with Chilean regulations and legislation. Any controversy arising from the service, in relation to these terms and conditions, will be submitted exclusively to the competent courts of the Commune of Santiago, in Santiago de Chile, Metropolitan Region. If the user does not agree with these terms and conditions, they should not use the FICSCOMPANY service. The use of the private investigation service implies acceptance of all the terms and conditions established above.
